Terms of Use

These Terms of Use ("Terms") govern access to GrantWhisperer, a BitCraft-developed platform operated by Tateway Enterprises, LLC ("Tateway," "we," "us," or "our"). By creating an account or using GrantWhisperer, you agree to these Terms and our Privacy Notice.

Purpose of the service

GrantWhisperer helps users organize applicant information, define funding needs, and evaluate grant readiness using structured, explainable criteria. The current service does not promise grant eligibility, opportunity matching, proposal acceptance, funding, or an award.

Eligibility and authority

You must be at least 18 years old and legally capable of accepting these Terms. If you use GrantWhisperer for an organization or another applicant, you represent that you are authorized to provide the information and act on that applicant's behalf.

Accounts and security

You must provide accurate account information, maintain control of your sign-in credentials, and promptly report suspected unauthorized access. You are responsible for activity conducted through your account unless applicable law provides otherwise. You may not share access in a way that bypasses account ownership or security controls.

Your information and responsibilities

You retain ownership of information you submit. You grant Tateway a limited permission to host, process, reproduce, and display that information solely as needed to operate, secure, support, and improve GrantWhisperer. You are responsible for the accuracy, lawfulness, and completeness of submitted information and for obtaining any permissions required to provide it.

Readiness results and professional advice

Readiness scores, coverage measures, explanations, checklists, and suggested next steps are informational and organizational tools. They are not legal, tax, accounting, financial, or grant-writing advice and are not determinations by a funder or government agency. You should verify opportunity requirements with official sources and consult qualified professionals when appropriate.

Acceptable use

You may not use GrantWhisperer to:

• Submit false, misleading, unlawfully obtained, or infringing information.
• Impersonate another person or organization or misrepresent your authority.
• Attempt to access another user's account, applicant records, or assessment history.
• Probe, disrupt, overload, reverse engineer, or circumvent service or security controls.
• Use automated means to scrape or extract information except with our written authorization.
• Use the service for unlawful, fraudulent, abusive, or harmful activity.

Third-party services

GrantWhisperer relies on third-party services, including Clerk, Google, Vercel, Neon, and PostgreSQL infrastructure. Your use of optional third-party features may also be governed by their terms and privacy practices. We are not responsible for third-party services outside our control.

Intellectual property

GrantWhisperer, its software, interface, assessment framework, text, graphics, trademarks, and other platform materials are owned by Tateway or its licensors and are protected by applicable law. These Terms grant you a limited, revocable, nonexclusive, nontransferable right to use the service for its intended purpose. They do not transfer ownership of the platform or its content.

Service changes and availability

GrantWhisperer remains under active development. We may add, change, suspend, or discontinue features; impose reasonable limits; or perform maintenance. We do not guarantee uninterrupted or error-free availability. We will use reasonable care when changes materially affect stored applicant records.

Suspension and termination

We may restrict or terminate access when reasonably necessary to address a violation of these Terms, unlawful conduct, security risk, harm to others, or service integrity. You may stop using the service at any time and may request account deletion as described in the Privacy Notice.

Disclaimers

To the fullest extent permitted by law, GrantWhisperer is provided "as is" and "as available." Tateway disclaims implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. Nothing in the service guarantees that an applicant is ready, eligible, competitive, compliant, or likely to receive funding.

Limitation of liability

To the fullest extent permitted by law, Tateway and its affiliates, officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, opportunities, data, or goodwill arising from use of or inability to use GrantWhisperer. Applicable law may provide rights that cannot be waived, and these limitations apply only to the extent that law permits.

Governing law

These Terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles. Any dispute will be brought in a court with jurisdiction in Mississippi unless applicable law requires otherwise.

Changes to these Terms

We may update these Terms as the service develops. The effective date above identifies the current version. Continued use after updated Terms take effect constitutes acceptance where permitted by law. If you do not agree, stop using the service.
